Powernality™ / IDF-SBA
Website Development & Hosting Terms
Effective October 21, 2026. These terms govern designated Funding-Ready Website builds, website makeovers, and related website/hosting services provided through IDF-SBA. The contracting provider is Powernality, Inc. IDF-SBA is a service of Powernality, Inc.
Before paying: Website design packages are limited-scope professional services, not unrestricted custom design. Accepted project/enrollment payments are final and non-refundable, except where applicable law requires otherwise. Enrollment does not include unlimited revisions, added pages, new content creation or changes of creative direction.
IMPORTANT: Meaning of “Funding-Ready”
“Funding-Ready” means that we organize and present the information your organization supplies according to professional website presentation practices we consider useful, particularly for Corporate Community Funding Programs (CCFPs). It does not mean IDF-SBA or Powernality, Inc. has verified that the organization is operationally, financially, legally or otherwise eligible for funding.
Each funder, grantmaker, company and support program applies its own criteria, including requirements that may be unpublished or later changed. We do not guarantee that a website meets any funder’s complete requirements, results in an award, or corrects any deficiency in the organization itself. Creating or making over a website does not constitute certification, verification, accreditation or endorsement of the organization, its claims or programs. The organization remains responsible for the accuracy and substance of the information it provides.
1. What is included
Your signed offer, enrollment agreement, accepted project brief and invoice define the services, fee, page count, hosting term and any special benefits. A standard Funding-Ready Website or makeover is limited to up to seven (7) pages unless your particular signed agreement states otherwise. A website may contain fewer than seven pages when that is the best professional presentation of the material. We may combine, shorten, organize or omit nonessential content. A makeover is not a page-for-page recreation of an existing site; a first website is not a custom-branding or unlimited copywriting engagement.
Unless expressly included in writing, services do not include custom software or integrations, ecommerce development, payment processor configuration, specialized accessibility certification, legal/compliance review, domain registration or renewal, premium licenses, ongoing content management, new organizational biographies, new program descriptions, new outcome statistics, major original copywriting, or unlimited images and media creation. Selected funding training, if awarded or purchased separately, follows the terms of that specific program. Funding is never guaranteed.
2. Client materials and deadlines
You must supply complete, accurate, usable organizational details, approved mission and program descriptions, public contacts, brand assets, photographs, rights-cleared text, links, requested access and timely decisions through the approved intake. You confirm you have permission to use all supplied material. You are responsible for the truth of your claims, your nonprofit’s programs and any donation/payment instructions.
Standard intake expectation for all website projects: Unless a signed agreement or written grant/award terms expressly establish a different deadline, the organization must provide all materials, information, approvals and access requested in our official website intake instructions within forty-eight (48) hours after those instructions are delivered. The requirement applies whether development or hosting is purchased, discounted, grant-funded or complimentary.
If the 48-hour intake deadline is missed: The project loses its accelerated production position and moves to the back of the active website development queue. Once the missing requirements have been received and accepted, production will be scheduled based on work already ahead of it. The normal anticipated delivery may be extended by up to ninety (90) additional calendar days depending on queue capacity; we will provide a revised estimated completion date. Missing the 48-hour expedited-intake deadline does not itself revoke or cancel a separate YES Grant award, and any grant resource activation/expiration provisions remain governed by that written award.
Standard completion target: Our target is seven (7) business days after the project is ready for production, including receipt of complete usable intake, required materials and access, confirmed scope, approvals, and cleared payment where payment is required (or confirmed activation where an in-kind award provides the service). This is an estimated professional service target, not an unconditional guarantee. Client delays, re-queuing after late intake, third-party dependencies, and approved scope changes may extend it. Work may pause while prerequisites remain incomplete.
3. Professional creative discretion
By enrolling, you expressly grant our professional design team creative license over the website’s visual direction and presentation. We determine the structure, look and feel, typography, layout, colors within a reasonable brand fit, content placement, navigation, condensation, and organization of the material to create a clear, professional, funding-ready presentation. Intake examples, color preferences and inspiration websites inform the work but do not create a right to copy another site or to direct each creative decision. This is a professional design service, not an open-ended co-design process.
4. One consolidated correction pass
The stated package includes one (1) consolidated edit/correction request after the initial version is made available for review. Combine all factual inaccuracies and material we implemented incorrectly into one written submission. The included correction pass is not a new design round, an opportunity to add fresh copy, images or pages, a new feature request, a layout rearrangement, a direction change, or a request to preserve every element of an old website. Additional or out-of-scope work requires a separate written proposal and price approval before any such work begins. We will correct material implementation mistakes under the accepted scope; we do not promise that every preference will be adopted.
5. Grants, complimentary services and scope
These Website Development & Hosting Terms apply regardless of whether a service is purchased at the regular, nonprofit or Member rate, discounted, or provided partially or fully as a complimentary in-kind grant benefit. Grant-funded or complimentary delivery does not expand the permitted page count, design scope, correction allowance, or support term unless the particular written award expressly provides otherwise.
In-kind website or hosting awards are not cash or cash equivalents. An unredeemed, declined, canceled or expired in-kind benefit does not entitle the recipient to cash, reimbursement of its stated grant value or a substitute cash payment. Any refund rules apply only to payments actually made and remain subject to applicable law. The YES Grant remains independent of purchases: its application is free and purchases or Membership do not determine approval or receipt of a YES award.
6. Hosting term, customer classes and renewals
Any included complimentary hosting and SSL must be specified in the individual written agreement or award. It may be 0, 3, 6, 12 or another stated number of months. Where complimentary hosting is included, its term begins when the completed website is published on the production domain, unless the signed agreement expressly defines a different start. Where no complimentary term is provided, paid hosting requires separate acceptance. Domain registration and renewal, outside subscriptions and licensed products are not included unless expressly stated. Hosting alone does not include content updates or Website Care.
Current IDF-SBA Website Essentials monthly prices (website builder, hosting and SSL):
| Customer category | Current monthly rate |
|---|---|
| Regular / Public | $27.77 |
| Verified Nonprofit | $17.77 |
| IDF-SBA Member | $4.77 |
| Eligible active IDF-SBA PLUS | $0 |
Prices depend on the organization’s qualified customer class. Rates may change prospectively at any time without individual notice, except where notice is required by applicable law, an existing billing authorization or specific written agreement. Current rates will be maintained publicly on the IDF-SBA website and the applicable rate disclosed before a new purchase or renewal authorization. The current prices above are not a permanent guarantee. After any grant or complimentary hosting term expires, the rate for which the organization then qualifies applies unless its specific signed agreement expressly provides an exception.
Special two-organization 2026 demonstration exception: only if stated in its signed agreement, a pilot organization may continue website hosting at the then-current IDF-SBA Member Website Essentials rate even without retaining or purchasing Membership. The current Member rate is $4.77/month. The exception concerns pricing eligibility, not a lifetime fixed-price promise. No recurring charge is authorized by a one-time website agreement; see Terms of Use, Section 6.
DNS and existing email: Before we change DNS or migrate an existing site, the organization is responsible for downloading/backing up existing email, contacts, calendars, site data and other assets. Unless separately agreed, we do not migrate/recover old email or unrelated hosting data. Do not change DNS until instructed.
7. Final payments and governing dispute policy
Website enrollment and development services reserve limited professional production capacity. Unless a signed agreement expressly provides otherwise, accepted development or enrollment fees are final and nonrefundable; cancellation for convenience, change of mind, project abandonment, failure to supply required materials or revised aesthetic preference does not create an optional refund right, except where applicable law requires otherwise. Discounted or grant-supported services follow the same scope and correction rules as paid projects; an in-kind award cannot be redeemed or exchanged for cash.
The existing IDF-SBA Terms of Use governs payment processing, renewal, service claims, disputes and arbitration, including Sections 6 and 16. These website terms do not create a second dispute process or override those provisions or any non-waivable rights.
8. Site ownership and third-party rights
You retain ownership of original organization content you lawfully provide, including your name, mission statements and approved photographs. We and our licensors retain our underlying designs, themes, reusable templates, build systems, software, licensed components and pre-existing creative tools, subject to any specific ownership promise in the signed agreement. Following full payment, you receive the right to use the final delivered website under the applicable website-hosting and third-party license terms. Some platform components are not freely transferable; any available export/transition options depend on platform and licensing limitations and will be explained on request.
9. Testimonials and case studies
Any public feature, before-and-after examples, screenshots, brand use, testimonial, personal likeness, or national promotional appearance is subject to the specific consent in your enrollment agreement. We do not require positive reviews or scripted endorsements. An honest testimonial may be favorable, mixed or critical; advertising will not materially alter its meaning, and material participation benefits will be disclosed when required. A standard website order alone is not permission to use an individual’s face, voice or personal story.
10. No funding, eligibility, performance or compliance guarantee
Our use of the expression “Funding-Ready” refers to known professional presentation practices, particularly around Corporate Community Funding Programs, not any promise of grant or funder eligibility. We rely on information the organization supplies and cannot verify every aspect of its actual operations, finances, compliance or mission results. Funders independently set their own criteria, sometimes without publishing them. A website cannot guarantee compliance with all requirements, search visibility, donations, grant approvals or financial results. By building or hosting a website, IDF-SBA and Powernality, Inc. do not certify, verify, endorse or recommend the organization. The organization remains responsible for its own statements, legal notices, privacy practices, fundraising activity, funder applications and eligibility checks.
11. Hosting acceptable use, suspension and termination
Any website, hosting or related service obtained through IDF-SBA must comply with the Website Hosting Acceptable Use Policy (AUP), these Website Terms and the general Terms of Use. The AUP explains prohibited uses, customer obligations, security responsibilities, resource limits and enforcement.
Temporary suspension and permanent disabling. If we reasonably determine that a website, its contents or use violates applicable terms, law, upstream-service conditions or creates a material security, legal or operational risk, Powernality, Inc. / IDF-SBA may restrict, suspend or disable hosting, email or related services and, where warranted, permanently terminate the affected services. We may offer notice and an opportunity to cure an issue when reasonably practical. We reserve reasonable discretion to determine whether a violation is remediable, whether the response sufficiently cures it, and whether continued service is safe. An immediate restriction or permanent disabling without a cure period may be necessary for serious, repeated, unremediable or urgent misconduct, including fraud, malicious activity, unlawful content, threats to systems or third parties, or legally required/provider-directed action.
No automatic credits or refunds for violations. Suspension or disabling attributable to a customer’s violation of these Website Terms, the AUP or applicable general Terms does not create an entitlement to a refund or credit for paid fees or unused service time, except where required by applicable law or an express written agreement. We may permit export of customer-owned content where lawful and reasonably practicable, subject to safety, provider/licensing and retention requirements. These provisions do not waive statutory remedies or nonwaivable protections.
Risk allocation and outside expenses. Customers control their own advertising commitments, event costs, fundraising campaigns, outside services and business decisions and should maintain independent contingency plans. IDF-SBA and Powernality, Inc. do not guarantee uninterrupted service and, to the maximum extent legally permitted, will not be responsible for indirect, special or consequential losses such as advertising spending, missed events, lost donors, expected revenue, profits or campaign opportunities resulting from service interruptions, even if those losses were foreseeable or we were advised of their possibility. The separate aggregate liability cap in general Terms of Use, Section 13 continues to apply. Applicable law may require exceptions, including for certain forms of intentional or grossly negligent misconduct; nothing here seeks to exclude liability that cannot lawfully be limited.
12. Relationship to other governing terms
These website-specific terms are incorporated when referred to by an accepted website agreement, order or in-kind award and otherwise supplement the IDF-SBA Terms of Use and Privacy Policy. The signed agreement or award notice governs its particular price, included services, hosting period and express pilot exceptions. These terms govern the common website scope, professional creative discretion and correction limits. The main Terms of Use controls general payment, dispute-resolution, arbitration, liability and other sitewide provisions. Nothing here is intended to create a conflicting dispute or refund procedure or eliminate non-waivable statutory protections.
