Website Hosting Acceptable Use Policy

Effective October 22, 2026. This Acceptable Use Policy (“AUP”) applies to websites, domains, hosted email, storage, accounts, and related hosting services operated or supplied through IDF-SBA, a service of Powernality, Inc. It supplements the Website Development & Hosting Terms and the IDF-SBA Terms of Use. The organization that orders or receives hosting is responsible for its authorized users and content. This AUP applies whether hosting is paid, discounted, complimentary, or funded by an in-kind award.

1. Lawful, accurate and rights-cleared content

Customers must not use hosted services to distribute unlawful, fraudulent, knowingly misleading, defamatory, threatening, harassing, or infringing material; impersonate another organization; falsely claim government, funder, professional, or IDF-SBA endorsement; promote scams or fraudulent fundraising; or publish content for which they lack required copyright, trademark, privacy, publicity, or other rights. Customers remain responsible for organization descriptions, fundraising disclosures, consent to publish stories or photographs, privacy notices, and lawful collection and use of personal information.

2. No spam, phishing or abusive messaging

Hosted domains, websites and email must not be used for unsolicited bulk messaging, deceptive sender identification, phishing, credential theft, unlawful fundraising solicitation, malicious links, purchased/harvested recipient lists used without proper permission, or communications that violate applicable anti-spam, privacy, or consumer-protection laws. Comply with applicable opt-in, unsubscribe, sender-identification, and recordkeeping requirements. Do not operate open relays or repeatedly send email that generates material abuse or deliverability complaints.

3. Security and prohibited technical activity

Do not store or distribute malware, ransomware, botnets, exploit kits, unauthorized mining software or malicious code; conduct intrusion attempts, password attacks, port scans against systems without authorization, denial-of-service activity, security-control bypasses or credential harvesting; or use a hosted property to interfere with IDF-SBA, other customers, hosting suppliers or third parties. Customers must use reasonable security practices, protect their credentials, keep any customer-managed software updated, and promptly report suspected compromise.

4. Fair resource use and third-party limits

Hosting may be subject to published technical, storage, bandwidth, CPU, email-delivery, acceptable-traffic and upstream-provider limits. Do not deliberately consume disproportionate resources, run prohibited high-load processes, evade quotas or use a website or email account to disrupt other hosted services. Where usage threatens stability or exceeds available capacity, we may throttle, isolate, restrict a particular resource or request an appropriate service change. We do not promise unlimited hosting, traffic, storage or sending unless an individual written agreement expressly does so.

5. Customer responsibilities and cooperation

Customers are responsible for authorized users, accurate contact details, domain-registration responsibilities, lawful site content, and cooperation with reasonable abuse, security, rights or regulatory inquiries. Keep independent copies of important materials and email. Notify us promptly of suspected abuse, lost access, security incidents or claims involving hosted material. Do not change DNS, discard existing backups or transfer administrative control contrary to written migration instructions. We may request information reasonably needed to verify authority, investigate suspected violations, restore access or satisfy provider/legal requirements.

6. Investigation, temporary suspension and permanent disabling

If we reasonably believe hosted content or use violates this AUP, the applicable Website Terms or general Terms of Use, applicable law, or an upstream provider’s valid restrictions, we may investigate, remove or disable affected material, restrict functions, temporarily suspend access or hosting, or permanently disable or terminate the affected service. We will exercise reasonable discretion considering the available evidence and the nature, severity and repeat history of a violation.

Where practical and appropriate, we may provide notice and a reasonable opportunity to correct a remediable violation. Advance notice or a correction period is not required when we reasonably believe immediate action is necessary to contain an active threat, protect people or systems, comply with law or provider directions, prevent substantial harm, or address serious, repeated or incurable misconduct. We may determine, exercising reasonable discretion, that a violation cannot adequately be remedied or that proposed corrections do not sufficiently reduce the risk. Restoration after suspension is not automatic; it may depend on satisfactory remediation, review and available service capacity.

7. Fees, credits and available records

Suspension or termination attributable to a customer’s violation does not, by itself, give the customer a right to reimbursement of amounts paid or a credit for unused service time, except where applicable law or a specific written agreement requires otherwise. This AUP does not waive valid billing errors, statutory refund rights or other nonwaivable remedies. Where lawful, technically feasible and safe, we may offer reasonable access to export customer-owned material following termination, subject to security, third-party licensing, retention restrictions, unpaid third-party charges where legally enforceable, and preservation obligations; continued hosting or restoration is not guaranteed.

8. Availability, external consequences and limits

Website availability can be affected by networks, registrars, DNS, power, internet providers, software, security incidents, planned maintenance, customer changes, third-party services and circumstances beyond our reasonable control. Customers should not rely on uninterrupted website or email availability to support advertising purchases, time-sensitive campaigns, special events or other major commitments without appropriate independent contingency arrangements. Indirect and consequential losses, and any cap on IDF-SBA/Powernality, Inc. liability, are governed by the Terms of Use, especially Sections 12 and 13, to the maximum extent permitted by law. This AUP does not remove legal protections that cannot be waived.

9. Related terms, review and changes

The individual signed offer or award controls its expressly agreed price, services and hosting duration. The Website Development & Hosting Terms controls website scope and service-specific enforcement; the general Terms of Use controls general claims and disputes, including arbitration. Material changes to this AUP will be handled subject to applicable law, contractual commitments and any required notice. For questions, notices or complaints, use our Contact page.
